These Terms govern your use of FilmMortal (filmmortal.com), operated by Webtronaut Innovations LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110 ("FilmMortal", "we"). By creating an account you agree to them.

1. What FilmMortal is

FilmMortal is a marketplace where producers of films, series and other video productions ("Filmmakers") list product placement opportunities and brand owners ("Brands") make offers. Deals are contracts between the Filmmaker and the Brand under the Standard Placement Agreement. FilmMortal is not a party to those creative obligations, is not an agency for either side, and does not guarantee that any production will be completed, released, or reach any audience.

2. Accounts

You must be 18 or older and able to form a binding contract. Information you provide must be accurate, including who you represent. You are responsible for activity on your account and for keeping your password secure. We may suspend accounts that break these Terms, misrepresent a project or brand, or put other users at risk.

3. Listings and offers

Filmmakers must have the right to make the placements they list and must describe their projects honestly. Audience figures should be good-faith estimates. Brands must have authority to offer the products they offer. You may not use FilmMortal to place products that are illegal where the production is made or distributed, or to target minors with age-restricted products.

4. Value estimates

Value estimates and fair-price ranges are calculated by a published formula and are informational only. They are not appraisals, audited measurements, financial advice or guarantees.

5. Fees and payments

Filmmakers pay no fees. Brands pay a platform fee per deal as shown on the Pricing page and at checkout. Payments are processed by Stripe; payouts to Filmmakers require a connected Stripe account and are subject to Stripe's terms. FilmMortal holds funds as limited payment agent for the Filmmaker and releases them as described in the Standard Placement Agreement. Placement Intel subscriptions renew monthly until cancelled.

6. Don't take deals off-platform

If you meet through FilmMortal, close that deal on FilmMortal for 12 months. Off-platform payments aren't protected, don't receive a clearance letter, and may lead to account suspension.

7. Content

You keep ownership of what you upload. You give FilmMortal a license to host and display it to operate and promote the marketplace (for example, showing a public project listing). Don't upload anything you don't have rights to, or that is unlawful, hateful or sexually explicit.

8. Disclaimers and liability

FilmMortal is provided "as is". To the fullest extent permitted by law, FilmMortal is not liable for indirect or consequential damages, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Disputes

Disputes between users about a deal follow the Standard Placement Agreement. Disputes with FilmMortal are resolved by binding individual arbitration in New Mexico, and New Mexico law governs, except that either side may bring qualifying claims in small-claims court.

10. Changes

We may update these Terms; material changes will be notified by email or in-app at least 14 days before they apply to existing deals. Contact: support@filmmortal.com.
